Your contract is between Kimsa Travel (hereinafter "Kimsa") and you. Please review the following terms and conditions, which apply to all brochures, correspondence, and reservations made with us. No one has the ability to deviate from these terms and conditions when entering into a contract with us. When making a reservation with us, you must confirm that you have read and comprehended the following terms and conditions (raising any queries you may have with us). By requesting confirmation of your reservation, you accept the following terms and conditions and acknowledge that you have read and agree with them.
Kimsa will tailor a holiday itinerary to your specific requirements. Upon receipt of any monetary payment (whether partial or full) for this itinerary, a legally enforceable agreement is formed between us. There will be no contract between the parties until such funds have been received.
When booking more than 90 days in advance of the date of travel, a minimum deposit of 25% is required at the time of booking confirmation, with the remaining balance due 90 days prior to departure. When booking less than 90 days prior to departure, full payment is required at the time of booking confirmation.
If full payment is not received 90 days prior to departure, we reserve the right to cancel your reservation and apply the cancellation fees outlined in section 5. We will not incur any cancellation fees, and we will have no further obligations to you. If you have provided us with your credit or debit card information, you consent to our use of such information to obtain payment of any balance due by you under this agreement, unless you have notified us in writing that the credit or debit card on file is not to be used to pay any outstanding balance.
The lead booking name is responsible for making full payment for all booking party members, and all booking party members accept these terms and conditions (including anyone added or substituted at a later stage). The person making the reservation is responsible for ensuring that all members of their party are aware of and have read these terms and conditions.
Please inform us prior to confirming your reservation if you or any member of your party has a medical condition or disability that may influence your travel, so that we may advise you on the suitability of the chosen arrangements. In any case, you must provide us with complete information in writing at the time of booking to ensure that the trip is suitable for the conditions. If complete information is not provided at the time of booking, we reserve the right to cancel in accordance with section 5 below without incurring any fees.
Please review your confirmation invoice, tickets, and any other documentation we provide you immediately upon receipt. If any information appears to be wrong, please contact us promptly, as it may not be possible to make corrections later. You are responsible for all charges and expenses associated with correcting any errors, unless we made an error.
Cancellation of a trip must be made in writing and is effective as of the date we receive the letter. The deposit and any amendment fees will be lost upon cancellation. Cancellation fees are represented as the following percentage of the advertised price:

If the cause for cancellation is covered by your insurance coverage, you may be entitled to recover these fees. Notwithstanding of the aforementioned, if we have provided you plane tickets and you want to cancel them at any point, we will only return the amount we recover from the airline.
The cost of your itinerary will be dependent on costs known at the time the itinerary is issued. All advertised prices are accurate as of the date of publication, but we retain the right to change them at any time. Prices include projected costs for fuel and municipal taxes as of the date of publishing. At the moment of booking confirmation, you will receive an Invoice Confirmation.
After sending you a Confirmation Invoice, we reserve the right to apply a supplement to your trip expenses if the cost of providing your travel increases. Any increase to your travel price will be the result of a change in our costs of providing your travel as a result of transportation charges, (fuel, airport charges, scheduled air fares, and other transport charges which form part of our contract with the transport provider), dues or taxes payable locally, VAT or IGV, currency fluctuations, and government action, as well as any other airline surcharges, taxes or fees payable for services such as landing taxes, embarkation or disembarkation fees. If our expenses to provide your trip increase, we have the right to alter the price of your travel and will send you an Amendment Invoice that reflects any adjustments.
If you ask your credit/debit card issuer to "charge back" any payment(s) properly due to you in relation to your booking, you will be charged a fee of $100 per incident in addition to any other fees incurred. In addition, we retain the right to terminate your reservation and/or pursue legal action for any unpaid balances (s).
We retain the right to adjust rates and correct errors at any moment before your reservation is confirmed. We will inform you of any inaccuracies that we are aware of as well as the current price at the time of booking.
If you wish to amend your itinerary after a deposit has been paid, we will do our best to accommodate your request if you notify us in writing of the intended modifications. For customer-initiated changes to the booking after payment has been received, we will assess a $150 cost. Other airline, hotel, and/or supplier fees may also apply. The booking will be re-priced at the rate in place at the time of any changes, and extra deposits or balance payments may be necessary to confirm the change. A "name change" is considered a cancellation and is subject to the cancellation fees outlined in paragraph 5.
We reserve the right to cancel your confirmed travel if you fail to comply with any of these booking terms. In addition, we have the right to cancel your trip for any reason prior to receiving complete payment.
We cannot assume liability or pay compensation if the prompt fulfillment of our contractual obligations is prohibited or impaired by force majeure, or if you suffer damages or losses as a result. In these booking conditions, "force majeure" refers to any event that neither we nor the service provider in issue could have reasonably foreseen or avoided. Such events are likely to include war, the threat of war, civil strife, riot, civil disorder/unrest, industrial dispute, actual or potential terrorist activity, natural or nuclear disaster, fire, outbreak of an epidemic or pandemic disease, technical problems with transportation, cancellation or amendment of any scheduled flight, closure, congestion at airports or ports, adverse weather conditions, and all similar events beyond our control. In cases of force majeure, we are not obligated to return you any money; nevertheless, if we are able to collect any funds from our suppliers, we will refund these funds to you at no cost.
While we make every effort to avoid alterations and cancellations, we must reserve the right to make them. If we cancel your trip for a reason not listed above, we will refund all payments made or provide an alternate trip of equivalent quality. In this situation, we will compensate each individual $100 USD.
Although it is unlikely that we will need to alter your travel plans, we reserve the right to do so at any moment. The majority of these modifications are small, and we will notify you of them in writing as soon as feasible. When an alteration of your outward or return flights by more than 12 hours or a significant change in the standard of accommodation is required, you will have the option of accepting the new arrangements or canceling your travel and receiving a full refund of all monies paid, provided it does not result from conditions amounting to I force majeure, (ii) failure to comply with these booking terms and conditions, (iii) failure to make payments when due, or (iv) a change in your personal circumstances.
Subject to clause 13 below, we assume responsibility for ensuring that I your trip is delivered as outlined in your Confirmation and any Revision Invoices, and (ii) the services provided meet an acceptable local level. Please be advised that we cannot accept responsibility for any services not included in our contract. This includes, for example, any additional services or facilities that your hotel or other supplier agrees to provide for you, but which are not featured in our brochure and for which we have not agreed to arrange. The information in our brochure and on our website is accurate to the best of our knowledge at the time your reservation is confirmed.
Our brochure descriptions and other information offered or made available in a resort sometimes allude to "additional resort activities and excursions." These events and excursions are not organized nor managed by us. Even if we suggest or promote particular operators/centres/trips and aid you in scheduling such activities or excursions, they do not form any part of your contract with us. Hence, we cannot bear responsibility for these outside activities and trips. When we create or accept reservations for or from you for any available activity or trip, we do so only as booking agents. It does not matter if the activity is offered or discussed in our brochure, resort, website, or elsewhere. Your contract for such an activity or trip will be with the activity or excursion's provider or operator. We are not liable for any such excursion or activity, nor for any acts or omissions of the provider or operator, its/their employees or agents, or any other person associated with the trip or activity. If we are found accountable in any way, such as in our function as a booking agency, for any such activity or excursion, our liability is limited to the cost of the activity or excursion in question.
Please keep in mind that the infrastructure in the nations you are visiting may not match that of your home country. Occasionally, resorts may experience power outages or water shortages. We are not liable for any injury, illness, death, loss (including loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever resulting from any of the following: a) The fault of the persons affected or any members of their party, b) The fault of a third party not connected with the booking of your travel, which we could not foresee or avoid, c) Force majeure and similar events, or d) The fault of anyone who is not a member of your This provision does not modify the liability limitations outlined in article 10, but it should be read to further limit our liability to you.
In addition, we will not be liable if you do not enjoy your trip or experience problems due to a reason you did not disclose when you booked your trip, or if the problems you experienced did not result from a breach of our contract, other fault on our part, or where we were responsible for them, our suppliers, or agents, or if any losses, expenses, costs, or other sum you have incurred are business-related.
Our suppliers, such as lodging or transport companies, have their own booking conditions or conditions of carriage, and these conditions are binding between you and the supplier. Some of these terms may reduce or eliminate the liability of the applicable transport providers and other suppliers to you. You can obtain copies of these terms and conditions from the appropriate suppliers' offices. You should also be aware that the carrier will rely on its conditions of carriage, which may limit or eliminate its liability to you and limit reimbursement under international treaties. We assume liability as outlined above only if a claim is submitted in writing within one month of your return.
You must confirm that your travel paperwork, passports, visas, and vaccination certificates are valid and that you have consulted with your primary care physician regarding immunizations. We will provide general guidance, but we cannot be held liable if you fail to comply with current standards prior to your departure. We do not take liability for any advise given of a general character prior to the travel commencing. You are responsible for a prompt check-in for all flights and for presenting oneself to take up all pre-booked components of your itinerary. No credit or refund will be offered to you should you fail to take up any component of your travel or if you lose any travel papers. We bring your attention to the fact that there are inherent hazards associated with all of the trips we offer, which you must accept at your own risk. If you desire to discuss any of these concerns with us, we are more than willing to offer advice over the phone or in writing.
You are need to have travel insurance. You must ensure that your insurance covers all of your particular needs, such as pre-existing medical conditions, cancellation fees, medical bills, and repatriation in the event of an accident or illness. If you opt to travel without proper insurance, we will not be responsible for any losses for which insurance coverage would have otherwise been available.
